Baycol Class Action Lawsuits Information
Baycol cholesterol-lowering drug was withdrawn from the
market in August 2001. Bayer AG, Baycol manufacturer, has had 8,800 Baycol
lawsuits filed against them in U.S. courts after a high number of Baycol
patients suffered rhabdomyolysis, a muscle-weakening disorder. In a February 24,
2003 report, court documents showed that Baycol manufacturer executives
continued to promote Baycol after the company was made aware of the fatal and
severe Baycol side effects occurring amongst Baycol patients.
By May 7, 2003, Baycol manufacturer had already paid $240 million to settle 785
Baycol lawsuits. Linked to more than 100 deaths, Baycol has found itself to be
in the midst of legal troubles that have been thought to be responsible for
setting off more drug litigation. Consumers, lawyers, and activist groups think
the increase in drug litigation, is largely due to instances like the Baycol
recall.
Court evidence has showed Baycol manufacturer deliberately avoided studying
potential risks of Baycol causing instances of rhabdomyolysis. Submitted
evidence shows a company memo saying, "If the FDA asks for bad news, we have to
give, but if we don't have it, then we can't give it to them" when referring to
Baycol. Many people died and suffered from serious Baycol side effects prior to
its' removal from the market.
Baycol Side Effects
Baycol was recalled in August 2001 after reports of serious
and deadly Baycol side effects continued to be made. Having settled 888 Baycol
lawsuits with 9,400 more cases pending, the most serious Baycol side effect
being named in the cases is rhabdomyolysis. Rhabdomyolysis has been linked to
all statins, however it has been found to occur on a much greater frequency as
one of the Baycol side effects suffered.
There have been over 100 deaths linked to Baycol side effects. Baycol
manufacturer has been criticized for failing to act adequately to reports of
Baycol side effects. Even the German health minister criticized Bayer for
delaying alerting patients of Baycol side effects.
More Baycol Information
There are a large number of Baycol lawsuits that have been

cell contents to enter the bloodstream. The number of Baycol lawsuits estimated
to be serious cases is 1,600. As of May 2003, Bayer had spent $240 million
settling 785 Baycol lawsuits. Controversy has surrounded Baycol and the German
health minister even criticized the German company’s delay at telling patients
of the dangers of Baycol, a point that only seemed to strengthen Baycol lawsuit
arguments.
